About our Privacy Policy
Pootendop.nl values your privacy highly. We only process data that is necessary for (improving) our services and handle the information we have collected about you and your use of our services with care. We will never share your data with third parties for commercial purposes.  

This privacy policy applies to the use of the website and the services provided through Pootendop.nl. The date of entry into force of these terms is 05/07/2021; with the publication of a new version, all previous versions will become invalid. This privacy policy describes which data about you we collect, how this data is used, and with whom and under what conditions this data may be shared with third parties. We also explain how we store your data, how we protect your data against abuse, and which rights you have regarding the personal data you have provided to us.

About Data Processing 
Below you can read how we process your data, where we (let) store it, which security techniques we use, and for whom the data is accessible.  

Webshop Software 
- MijnWebWinkel (part of Visma Software BV) 

Our webshop is developed and hosted by MijnWebWinkel, a company of Visma Software BV. Personal data that you make available to us for our services will be shared with this party. MijnWebWinkel has access to your data to provide us with (technical) support, but they will never use your data for any other purpose. MijnWebWinkel is obliged to take appropriate security measures based on the agreement we have made with them. These security measures include the application of SSL encryption and a strong password policy. MijnWebWinkel uses cookies to collect technical information regarding your use of the software, but no personal data is collected and/or stored through these. MijnWebWinkel reserves the right to share collected data within its own organisation to further improve the services.  

Email and Mailing Lists 
- MijnWebWinkel

Our webshop uses MijnWebWinkel's hosting for our primary domain name Pootendop.nl. This includes hosting the email address info@pootendop.nl. To limit the sharing of personal data as much as possible, all our confirmation emails, newsletters, and other correspondence are sent directly from the back office of our webshop.  
At the bottom of newsletters sent via our website, you will see the 'unsubscribe' link. If you click here, you will no longer receive emails from our website. You can also unsubscribe from newsletters via your account or request us to unsubscribe you via email. You are not obliged to provide a reason for this.  
- MijnDomein.nl 
In addition to the primary domain name, we have also registered the domain names Pootendop.be, Pootendop.com, and Legsandcaps.com. These are hosted by MijnDomein.nl. These domain names are set up in such a way that they only refer directly to the webshop. Therefore, no data about you is shared with this host in any way.  
We have also registered the domain name msgmeilink.nl with MijnDomein.nl. Under this domain name, we rent an email server (for instance, the email address info@msgmeilink.nl), and a redirect to our informative website www.meilink-stoffering.nl is facilitated. Aside from the data that you include in your emails, no one but ourselves will use that data.  

Payment Processors 
- Mollie Payments

To handle (part of) the payments in our webshop, we use the platform of Mollie, Payment Service Provider. Mollie Payments processes your name, address, residence information, and payment details such as your bank account or credit card number. Mollie Payments has taken appropriate technical and organisational measures to protect your personal data. Mollie Payments reserves the right to use your data to further improve the service and in this context, share (anonymised) data with third parties. In the event of a request for deferred payment (credit facility), Mollie Payments shares personal data and information regarding your financial position with credit assessors. All the aforementioned safeguards regarding the protection of your personal data also apply to the parts of Mollie Payment's services for which they involve third parties. Mollie Payments does not store your data longer than permitted under applicable legal retention periods. How your financial service provider (for example, your bank, payment service, or credit card company) handles the data provided by Mollie can be found in the General Terms and Conditions and Privacy Policy that you received upon entering into the agreement with your financial service provider, or on the website of your financial service provider.  
- Paypal 
For your PayPal payments, we do not use an intermediary payment provider like Mollie. These are handled directly via the PayPal platform. Thus, as an existing PayPal customer, you already know what to expect: your data will not extend beyond what you have agreed with PayPal according to their general terms, and the data you have recorded in your account with us. This keeps your data flow as short as possible.  
- Manual Transfer 
When you choose to manually transfer (or make the payment via internet banking or your mobile banking app), the data is shared with the fewest parties. Besides your account and order data, only your bank and our bank receive the payment details. We have already described how your data is processed for the first two; for the bank, the legal rules apply as agreed in the general terms and privacy policy with your bank. The same applies to our bank (ING Bank), which only receives the minimally required payment information from your bank (the amount, your name, account number, and added payment description).  

Reviews
- Trustpilot (from 1/10/2023)
 
We share your email address with Trustpilot (https://nl.trustpilot.com/review/www.pootendop.nl) so that they can send you an automated invitation a few days after your order to review us. You are not obliged to leave a review, and as long as you do not do so, Trustpilot will automatically delete your email address after three years or as soon as you request the Data Protection Officer of Trustpilot to do so.  
Once you decide to create an account or leave a review without an account, you agree to Trustpilot's terms of use and privacy policy, and you can find further information about their data management on this page. Your data will be maintained by Trustpilot for as long as you keep your account and/or reviews online there.  
- WebWinkelKeur
We also collect reviews via the WebWinkelKeur platform. If you leave a review via WebWinkelKeur, you are required to provide your name and email address. WebWinkelKeur shares this data with us so that we can link the review to your order. In some cases, WebWinkelKeur may contact you to provide clarification about your review. If we invite you to leave a review, we will share your name and email address with WebWinkelKeur. They will use this data solely for the purpose of inviting you to leave a review. WebWinkelKeur has taken appropriate technical and organisational measures to protect your personal data. WebWinkelKeur reserves the right to involve third parties in order to provide the services; we have granted WebWinkelKeur permission for this. All the aforementioned safeguards regarding the protection of your personal data also apply to the parts of the service for which WebWinkelKeur uses third parties. Shipping and Logistics 
- MyParcel & PostNL

When you place an order with us, it is our task to have your package delivered to you. We use the services of MyParcel (label service) and PostNL (post and parcel service) to carry out the deliveries. It is therefore necessary to share your name, address, and residence information with MyParcel and PostNL. MyParcel and PostNL use this data solely to execute the agreement. In the event that MyParcel and PostNL engage subcontractors (for example, when shipping abroad outside their usual service area), MyParcel and PostNL will also make your data available to these parties.  

External Sales Channels 
At this time, we do not work with external sales channels. As soon as we do start using such channels, we will update this change here.  

Billing and Accounting 
- MijnWebWinkel
 
As mentioned earlier, we use MijnWebWinkel's webshop software for invoicing. In the rare cases where we create an order manually, we generate the invoice in software and store it in-house. In that last case, your data will only be available to us for the duration of the maximum fiscal retention period, as described further below.  
- Accounting Software 
For accounting, we use our own software with storage in-house. In this case, all your data will only be available to us, and, if requested, to the tax authorities. This is for the duration of the maximum fiscal retention period, as explained in detail below.  

Retention Periods for Your Personal Data
- Fiscal Retention Obligation

Both we and all the aforementioned companies have a fiscal retention obligation of 7 financial years. For this, the retained data is limited to the minimum of the data on the invoices, for at least 7 years, and at most until 3 months after the fiscal completion of the last financial year (the final assessment). After this, the oldest financial year will be responsibly destroyed.  
- Other Personal Data 
All other personal data will be retained as long as you wish to maintain your account. Once you close your account, the order and billing information will be retained for as long as we are obliged to keep it, after which these last bits of information will also be destroyed.  

Purpose of Data Processing 
General Purpose of Processing

We solely use your data for the sake of our services. This means that the purpose of the processing is always directly related to the assignment you have given. We do not use your data for (targeted) marketing. If you provide data to us, and we use this data to contact you at a later time — other than at your request — we will explicitly ask for your permission. Your data will not be shared with third parties, apart from to comply with accounting and other administrative obligations. These third parties are all bound to confidentiality based on the agreement between them and us or by an oath or legal obligation.  

Automatically Collected Data 
Data that is automatically collected by our website is processed with the intention of further improving our services. This data (for example, your IP address, web browser, and operating system) is not personal data.  

Cooperation in Fiscal and Criminal Investigations 
In certain instances, Pasgeboren may be required to share your data based on a legal obligation in connection with fiscal or criminal investigations by the government. In such a case, we are compelled to share your data, but we will resist this within the limits allowed by the law.  

Retention Periods
We will retain your data for as long as you are our client. This means that we will keep your customer profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also interpret it as a request for forgetfulness. Under applicable administrative obligations, we are required to retain invoices containing your (personal) data; thus, we will retain this data for as long as the applicable period lasts. However, employees will no longer have access to your customer profile and documents generated by us in response to your assignment.  

Your Rights 
Under applicable Dutch and European legislation, you as a data subject have certain rights regarding the personal data processed by or on behalf of us. We will explain below what these rights are and how you can invoke them. In principle, we only send copies and extracts of your data to your already known email address with us to prevent abuse. Should you wish to receive the data at a different email address or via post, we will ask you to verify your identity. We keep a record of processed requests; in the event of a forgetfulness request, we maintain anonymised data. You will receive all copies and extracts of data in the machine-readable data format that we use within our systems. You have the right at all times to lodge a complaint with the Data Protection Authority if you suspect that we are using your personal data incorrectly.  

Right of Access 
You always have the right to view the data that we (let) process and that relates to you or can be traced back to you. You can submit a request for this to our privacy officer. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data concerning you held at our known email address, along with an overview of the processors that hold this data, mentioning the category under which we have stored this data.  

Right to Rectification 
You always have the right to have the data we (let) process that relates to you or can be traced back to you, adjusted. You can submit a request for this to our privacy officer. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at our known email address that the data has been adjusted.  

Right to Restriction of Processing 
You always have the right to restrict the data that we (let) process that relates to you or can be traced back to you. You can submit a request for this to our privacy officer. You will receive a response to your request within 30 days. If your request is granted, we will send you confirmation at our known email address that the data will not be processed any longer until you lift the restriction.  

Right to Data Portability 
You always have the right to have the data we (let) process that relates to you or can be traced back to you, made transferable by another party. You can submit a request for this to our privacy officer. You will receive a response to your request within 30 days. If your request is granted, we will send you extracts or copies of all data about you that we have processed or have been processed on our behalf by other processors or third parties to our known email address. In such a case, we will likely be unable to continue providing the service since the secure connection of databases can no longer be guaranteed.  

Right to Object and Other Rights 
You have the right in certain cases to object to the processing of your personal data by or on behalf of Pasgeboren. If you do object, we will immediately cease processing the data while awaiting the resolution of your objection. If your objection is deemed valid, we will provide you with copies and/or extracts of data that we (let) process and will subsequently cease processing permanently. You also have the right not to be subjected to automated individual decision-making or profiling. We do not process your data in such a manner that this right is applicable. If you believe that this is the case, please contact our privacy officer.  

Cookies
- Functional Cookies

Our webshop places functional cookies. These are necessary for the proper functioning of shopping at our shop. Without these cookies, the shop will not function properly.  
- Analytical Cookies 
Cookies from the American company Google are placed via our website as part of the "Analytics" service. We use this service to track and report on how visitors use the website. This processor may be required under applicable laws to grant access to this data. We collect information about your browsing behaviour and share this data with Google. Google may interpret this information in conjunction with other datasets, thereby tracking your movements on the internet. Google uses this information to offer targeted advertisements (AdWords) and other Google services and products.  
- Marketing Cookies
These cookies are used by Google Ads to track the browsing behaviour of visitors to monitor the performance of our advertisements and also to make you personalised offers.  

Changes to the Privacy Policy 
We always reserve the right to change our privacy policy. However, you will always find the most recent version on this page. If the new privacy policy affects how we process already collected data regarding you, we will inform you of this via email.
